Critical Medical Disclaimer

MediXGPT is an AI-powered educational tool only. It is NOT a medical device, diagnostic system, clinical decision support system, or substitute for professional medical judgment. It has not been evaluated, cleared, or approved by the Central Drugs Standard Control Organisation (CDSCO), the U.S. Food and Drug Administration (FDA), or any other regulatory authority. Never use MediXGPT output to make real clinical decisions, diagnose patients, prescribe medications, or guide patient care.

Acceptance of Terms

By accessing or using MediXGPT (“the Platform”, “Service”), operated by MediXGPT (“we”, “us”, “our”), you (“User”, “you”, “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not access or use the Platform.

By creating an account you represent that you are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) and have the legal capacity to enter into these Terms.

Nature of the Service — Educational Use Only

MediXGPT is an AI-assisted educational and informational platform designed exclusively for medical students, residents, healthcare professionals, and individuals interested in medical education. The Platform provides:

  • AI-generated responses to medical education queries
  • Drug information and dosage reference tools
  • DICOM medical image viewing and educational analysis
  • Clinical case simulations for training purposes
  • Exam preparation and spaced repetition tools
  • Medical guideline summaries and reference materials
  • Lab report educational analysis

All content, outputs, analyses, drug information, dosage calculations, case simulations, reference materials, and any other information provided by MediXGPT are strictly for educational and informational purposes. They are NOT intended for clinical use, patient care, diagnosis, treatment, or any form of medical practice.

Medical Disclaimers & Clinical Use Prohibition

3.1 — No Medical Advice

Nothing on MediXGPT constitutes medical advice, clinical guidance, a medical opinion, or a recommendation regarding diagnosis, treatment, cure, or prevention of any disease or health condition. The information provided is not a substitute for professional medical advice from a qualified, licensed healthcare provider.

3.2 — AI-Generated Content Warning

All AI-generated content on MediXGPT — including text responses, image analyses, drug information, dosage calculations, case simulation feedback, and guideline summaries:

  • May contain factual errors, inaccuracies, omissions, or hallucinated information
  • May be incomplete, outdated, or inconsistent with current medical evidence
  • Has not been reviewed or verified by a licensed medical professional before delivery
  • May not reflect the most current research findings, drug safety data, or clinical guidelines
  • May vary in accuracy across different medical specialties, conditions, and contexts
  • Should never be relied upon as the sole or primary source of medical knowledge

3.3 — Drug Information Disclaimer

Drug information, dosage calculations, interaction checks, and formulary data are for educational reference only:

  • Must NOT be used to prescribe, dispense, administer, or recommend medications to any person
  • May not reflect current prescribing information, manufacturer guidelines, or country-specific regulatory approvals
  • May contain errors in dosage, contraindications, drug interactions, or adverse effects
  • Does not account for individual patient factors (allergies, comorbidities, concurrent medications, pregnancy status, genetic variations)
  • Is not a substitute for official prescribing information, national formularies (e.g. Indian National Formulary), or a qualified pharmacist/physician

3.4 — Imaging & DICOM Disclaimer

The DICOM viewer and AI-assisted image analysis features are for educational demonstration only:

  • Does NOT constitute a radiological interpretation or diagnostic reading
  • Has not been validated for diagnostic accuracy and must not be used for clinical image interpretation
  • May miss findings, generate false positives, or provide incorrect anatomical/pathological descriptions
  • Cannot replace the judgment of a qualified radiologist or imaging specialist

3.5 — Lab Report Analysis Disclaimer

Lab report analysis features are for educational purposes only. Reference ranges vary between laboratories, populations, and methodologies. AI-generated interpretations must not be used for clinical decision-making. Always consult the originating laboratory and a qualified physician for clinical interpretation.

3.6 — Clinical Case Simulation Disclaimer

Clinical case simulations are fictional educational scenarios. They do not represent real patients and may present simplified, atypical, or deliberately challenging situations. Management approaches discussed should not be generalized to real patient care.

3.7 — Obligation to Verify

You are solely responsible for independently verifying all information obtained from MediXGPT against authoritative sources — including peer-reviewed literature, current clinical practice guidelines (ICMR, NMC, WHO), official formularies, and consultation with qualified medical professionals — before applying any knowledge in any context.

Prohibited Uses

You expressly agree NOT to use MediXGPT to:

  • Diagnose, treat, cure, or prevent any disease or medical condition in any real person
  • Make clinical decisions, prescribe medications, or provide medical advice to any person
  • Replace consultation with a qualified, licensed healthcare professional
  • Enter, upload, or transmit real patient data, protected health information (PHI), or any data subject to HIPAA, the Indian Digital Personal Data Protection Act (DPDPA) 2023, or equivalent regulations
  • Upload DICOM files or medical images containing real patient identifiers without proper de-identification
  • Represent AI-generated content as professional medical advice or expert opinion
  • Use the Platform in any clinical, hospital, or patient-care setting for decision support
  • Engage in any activity that violates applicable laws, regulations, or professional medical ethics
  • Reverse-engineer, decompile, or extract the underlying models or algorithms
  • Use automated scripts, bots, or scrapers to access the Platform beyond normal use
  • Share, redistribute, or commercially exploit Platform content without authorization
  • Circumvent rate limits, access controls, or security measures
  • Submit content that is illegal, harmful, threatening, abusive, or violates third-party rights

Violation of these prohibitions may result in immediate account termination without refund and may be reported to relevant authorities where required by law.

User Accounts & Responsibilities

5.1 — Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at ayush@medixgpt.com if you become aware of unauthorized use.

5.2 — Accurate Information

You agree to provide accurate, current, and complete information during registration and keep it updated. We may suspend or terminate accounts with false or misleading information.

5.3 — User-Generated Content

You retain ownership of content you submit (queries, uploaded files). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to process, store, and use it solely for providing and improving the Service. You represent that your content does not contain real patient data or PHI.

6

Subscriptions, Payments & Refunds

6.1 — Subscription Plans

MediXGPT offers free and paid subscription tiers. Paid features, usage limits, and pricing are described on our pricing page and may change with reasonable notice.

6.2 — Payment Processing

Payments are processed through Razorpay. By making a payment you also agree to Razorpay's terms of service. We do not store your complete payment card details on our servers.

6.3 — Recurring Billing

Paid subscriptions auto-renew at the end of each billing period (monthly or annual) unless cancelled before the renewal date. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period.

6.4 — Refund Policy

Subscription fees are generally non-refundable. Refund requests for exceptional circumstances may be submitted to ayush@medixgpt.com within 7 days of the charge and will be evaluated case-by-case. We reserve sole discretion over refund decisions.

6.5 — Price Changes

We may adjust pricing with at least 30 days' notice. Existing subscribers will be notified via email before any price increase takes effect on their next billing cycle.

Intellectual Property

7.1 — Platform Ownership

All rights, title, and interest in the Platform — including design, code, features, branding, and curated content (drug databases, reference cards, question banks, case templates, guideline summaries) — are owned by MediXGPT or its licensors and protected by intellectual property laws.

7.2 — Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal educational purposes in accordance with these Terms. This license does not permit modification, distribution, sale, or creation of derivative works from Platform content.

7.3 — AI-Generated Output

AI-generated responses are for your personal educational use. You may not represent AI-generated content as professional work product, medical advice, or expert analysis. We make no claim of ownership over AI outputs but provide no guarantee of their accuracy or fitness for any purpose.

8

Privacy & Data Handling

8.1 — Data Collection

We collect and process personal data as described in our Privacy Policy. By using MediXGPT, you consent to our data practices. We collect account information, usage data, chat interactions, and uploaded files to provide and improve the Service.

8.2 — No PHI Processing

MediXGPT is not designed or intended to process protected health information (PHI). We are not a HIPAA-covered entity or business associate. We do not enter into Business Associate Agreements (BAAs). You must not submit any real patient data, identifiable health information, or PHI to the Platform.

8.3 — DICOM De-identification

The Platform includes automated DICOM anonymization features provided on a best-effort basis. You are solely responsible for ensuring uploaded medical images are properly de-identified and free of PHI. We accept no liability for inadequate de-identification of uploaded files.

8.4 — Third-Party AI Providers

MediXGPT uses third-party AI model providers to generate responses. Your queries and uploaded content may be transmitted to these providers for processing. They have their own terms and privacy policies. We select providers with appropriate data handling practices but cannot guarantee their compliance with any specific regulatory framework.

8.5 — Data Retention & Deletion

Chat history and uploaded files are retained while your account is active. You may request deletion by contacting ayush@medixgpt.com. Upon deletion, we remove personal data in accordance with applicable law, subject to legitimate retention requirements (e.g. billing records, legal obligations).

Limitation of Liability

To the maximum extent permitted by applicable law

In no event shall MediXGPT, its founders, officers, directors, employees, agents, partners, suppliers, AI model providers, or licensors be liable for:

  • Any death, personal injury, or adverse health outcome arising from use of or reliance on information, drug data, dosage calculations, image analyses, lab report interpretations, or any other content provided by the Platform
  • Any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, goodwill, or other intangible losses
  • Any direct damages exceeding the total amount paid by you in the 12 months preceding the event, or INR 5,000, whichever is less
  • Any errors, inaccuracies, or omissions in AI-generated content, drug information, dosage data, reference ranges, guideline summaries, or any other Platform output
  • Any unauthorized access to or alteration of your data or transmissions
  • Any interruption, suspension, or termination of the Service

This applies regardless of legal theory (contract, tort, negligence, strict liability, or otherwise), even if MediXGPT has been advised of the possibility of such damages.

Disclaimer of Warranties

The Platform is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory. We expressly disclaim:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Accuracy, completeness, reliability, or timeliness of any content, drug data, or AI-generated output
  • Uninterrupted, secure, or error-free operation of the Platform
  • Fitness for medical, clinical, or diagnostic purposes — we explicitly disclaim any warranty that the Platform is suitable for clinical settings or patient care

Indemnification

You agree to indemnify, defend, and hold harmless MediXGPT, its founders, officers, directors, employees, agents, and licensors from all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the Platform
  • Your violation of these Terms
  • Your use of Platform content for clinical, diagnostic, or treatment purposes
  • Any claim that you submitted real patient data or PHI to the Platform
  • Your violation of any applicable law or regulation
  • Any third-party claim arising from your reliance on Platform content

Third-Party Services

MediXGPT integrates with third-party services including AI model providers (via OpenRouter), payment processors (Razorpay), cloud storage providers, authentication providers (Google OAuth), and analytics services. These services have their own terms and privacy policies. We are not responsible for their availability, accuracy, or practices.

Service Availability & Modifications

We reserve the right to modify, suspend, or discontinue any feature or the entire Service at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuation. We do not guarantee uptime or availability.

Termination

We may suspend or terminate your account at our sole discretion, without prior notice or liability, for any reason including breach of these Terms. Upon termination, your right to access the Platform ceases immediately.

Provisions that by their nature should survive termination — including Sections 3, 9, 10, 11, and 15 — shall survive.

Governing Law & Dispute Resolution

15.1 — Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

15.2 — Jurisdiction

Disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

15.3 — Dispute Resolution

Before filing legal action, you agree to first attempt informal resolution by contacting ayush@medixgpt.com. If unresolved within 30 days, either party may proceed with formal legal proceedings.

Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email or a prominent notice at least 15 days before taking effect. Continued use after the effective date constitutes acceptance. If you disagree, you must stop using the Platform and may request account deletion.

General Provisions

Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full force. The invalid provision will be modified to the minimum extent necessary to preserve its intent.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MediXGPT regarding use of the Platform and supersede all prior agreements and representations.

No Waiver

Our failure to enforce any right or provision shall not constitute a waiver. Any waiver must be in writing and signed by an authorized representative.
